Waltham Landowners File Court Complaint Over Sand Mine Approval

In what was only a matter of time, opponents to proposed sand mine north of Love’s Travel Stop are taking the village of Utica to court.

Around 30 people have signed on to be plaintiffs arguing that the village trustees approval of an annexation agreement and special use permits for Aramoni, LLC violated village ordinances, state law and due process requirements.  Attorney Walt Zukowski says the plaintiffs include people who live near the proposed mine or own land near it.  Among the people taking Utica to court is La Salle County Farm Bureau President Monty Whipple.

Zukowski says his clients want a judge to stop Aramoni from proceeding with their mine and want village trustees to hold a new hearing that follows proper process.

The village of Utica has 30 days to respond to the complaint filed in La Salle County Circuit Court.  A message was left with village attorney Herb Klein.
