People trying to mine sand northeast of Utica got a boost this week.
Illinois Sand, a division of Illinois Cement wants to mine over 500 acres near the Osage Curves. However over 60 people in rural Utica oppose them and are trying to block the development in court. In response, the sand company wants the court to throw out the people’s challenge.
Thursday, Circuit Judge Eugene Daugherity didn’t throw out the people’s challenge but he did keep in play Illinois Sands’ chance to have the landowners challenged tossed out.
