Streator Murder Sentence Upheld

Posted by wlpo on December 11, 2009

A Streator man serving a 45 year prison sentence for murder was denied a new sentencing hearing yesterday in Ottawa.

Lawyers for 22 year old Randall Jennings argued that Judge Cynthia Raccuglia said various things during sentencing that made it seem like she took part in plea negotiations, something that’s illegal.  Raccuglia denied the accusation and thus denied a new sentencing hearing.  Jennings plans to appeal her denial.

Jennings was sentenced in February after saying he was sorry for beating Cynthia Defenbaugh to death with a hammer in her Streator home back in 2002.  Jennings said he picked Defenbaugh’s house randomly to burglarize.  When she startled him, he beat her to death.  The only things he ended up stealing were a pack of cigarettes and a lighter.
